यूसीसी अधिनियम राज्य के सभी निवासियों पर होगा लागू
‘वैवाहिक शर्तों और व्यक्तिगत अधिकारों की सुरक्षा के लिए एक मजबूत विधिक ढांचा’
देहरादून। उत्तराखंड सरकार सामाजिक समरसता और व्यक्तिगत अधिकारों की सुरक्षा को प्राथमिकता देते हुए “यूनिफॉर्म सिविल कोड अधिनियम, 2024” को लागू करने जा रही है। यह अधिनियम राज्य के सभी निवासियों पर लागू होगा, चाहे वे राज्य के भीतर रह रहे हों या बाहर। हालांकि, संविधान के अनुच्छेद 342 और 366(25) के तहत अधिसूचित अनुसूचित जनजातियों तथा भाग XXI के अंतर्गत संरक्षित प्राधिकार/अधिकार-प्राप्त व्यक्तियों व समुदायों पर यह अधिनियम लागू नहीं होगा।
मुख्य प्रावधान और उद्देश्य
इस अधिनियम का मुख्य उद्देश्य विवाह संबंधी कानूनी प्रक्रियाओं को सरल, सुव्यवस्थित और पारदर्शी बनाना है। यह कानून व्यक्तिगत अधिकारों की सुरक्षा सुनिश्चित करते हुए सामाजिक समरसता को बढ़ावा देता है।
विवाह के लिए पात्रता:
दोनों पक्षों में से किसी के पास जीवित जीवनसाथी नहीं होना चाहिए।
दोनों मानसिक रूप से स्वस्थ और विवाह की अनुमति देने में सक्षम हों।
पुरुष की न्यूनतम आयु 21 वर्ष और महिला की 18 वर्ष होनी चाहिए।
दोनों पक्षकार निषिद्ध संबंधों की परिधि में न हों।
विवाह पंजीकरण की अनिवार्यता:
अधिनियम लागू होने के बाद, विवाह का पंजीकरण 60 दिनों के भीतर अनिवार्य होगा।
26 मार्च 2010 से अधिनियम लागू होने तक हुए विवाहों का पंजीकरण 6 महीने के भीतर करना होगा।
26 मार्च 2010 से पहले हुए विवाह, यदि सभी कानूनी योग्यताओं को पूरा करते हैं, तो वे भी (हालांकि अनिवार्य नहीं है) पंजीकरण कर सकते हैं।
पूर्व में नियमानुसार पंजीकरण करा चुके व्यक्तियों को दोबारा पंजीकरण कराने की आवश्यकता नहीं है, लेकिन उन्हें अभिस्वीकृति (Acknowledgement) देनी होगी।
पंजीकरण प्रक्रिया:
विवाह पंजीकरण ऑनलाइन और ऑफलाइन दोनों माध्यमों से किया जा सकेगा।
आवेदन प्राप्त होने के 15 दिनों के भीतर उप-निबंधक को निर्णय लेना अनिवार्य है।
15 दिनों के भीतर निर्णय न होने पर आवेदन स्वतः निबंधक को अग्रेषित होगा।
अभिस्वीकृति से संबंधित आवेदन 15 दिनों के पश्चात स्वतः स्वीकृत माना जाएगा।
पारदर्शी अपील प्रक्रिया:
आवेदन अस्वीकृत होने पर पारदर्शी अपील प्रक्रिया उपलब्ध है।
मिथ्या विवरण देने पर दंड का प्रावधान है।
पंजीकरण न होने का प्रभाव:
पंजीकरण न होने मात्र से विवाह अमान्य नहीं माना जाएगा।
निगरानी और क्रियान्वयन
राज्य सरकार विवाह पंजीकरण की प्रक्रिया की निगरानी और क्रियान्वयन के लिए महानिबंधक, निबंधन और उप-निबंधकों की नियुक्ति करेगी। ये अधिकारी संबंधित अभिलेखों का संधारण और पंजीकरण प्रक्रिया को सुचारू रूप से सुनिश्चित करेंगे।
